As perdas pela aplica\u00e7\u00e3o de \u00edndice inadequado no <strong>FGTS<\/strong> s\u00e3o matem\u00e1ticas, sendo, o trabalhador, inegavelmente prejudicado.<br>Por\u00e9m, com a <strong>Jurisprud\u00eancia do STF<\/strong> reconhecendo a incapacidade da remunera\u00e7\u00e3o da poupan\u00e7a de preservar o valor do cr\u00e9dito de precat\u00f3rios, passaram a existir grandes oportunidades em tese similar envolvendo o <strong>FGTS<\/strong>. Isto porque o fator de corre\u00e7\u00e3o do <strong>FGTS<\/strong> \u00e9 o mesmo da poupan\u00e7a, a <strong>Taxa Referencial (TR)<\/strong>, sendo que com o passar do tempo a <strong>TR<\/strong> acabou por n\u00e3o recompor o valor da infla\u00e7\u00e3o do per\u00edodo, possibilitando ganhos expressivos com a tese de aplica\u00e7\u00e3o de outros \u00edndices no lugar da <strong>TR<\/strong>.<br>A tese foi refor\u00e7ada por uma <strong>A\u00e7\u00e3o Direta de Inconstitucionalidade<\/strong> que est\u00e1 questionando justamente o trecho da disposi\u00e7\u00e3o legal que estabelece o uso da <strong>TR<\/strong> como fator de corre\u00e7\u00e3o para os dep\u00f3sitos das contas do <strong>FGTS<\/strong>. Como o <strong>STF<\/strong> j\u00e1 possui entendimento similar e a tese \u00e9 robusta, h\u00e1 grandes chances de \u00eaxito para o trabalhador.<br>Ent\u00e3o, voc\u00ea trabalhador, que laborou de <strong>CTPS<\/strong> assinada pelo per\u00edodo compreendido entre o ano de 1999 e 2013, vale a pena rever tal reajuste, \u201cantes que seja tarde demais\u201d.<\/p>\n\n\n\n<div
