O novo parecer trata da cobran\u00e7a do Imposto sobre Bens e Servi\u00e7os (IBS), de compet\u00eancia de estados e munic\u00edpios, e do funcionamento do Comit\u00ea Gestor, \u00f3rg\u00e3o respons\u00e1vel por administrar os recursos arrecadados.\u00a0<br>O deputado Mauro Benevides (PDT-CE) \u00e9 o relator do texto. Os parlamentares analisaram o projeto de lei complementar (PLP) 108\/24, de autoria do governo. O presidente da C\u00e2mara, Arthur Lira (PP-AL), afirmou que a regulamenta\u00e7\u00e3o da reforma deve ser votada pelo plen\u00e1rio a partir desta quarta (10).<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/jornalfatosenoticias.com.br\/wp-content\/uploads\/2022\/02\/Precisao-Contabilidade-1024x724.jpg\" alt=\"\" class=\"wp-image-28088\" width=\"303\" height=\"214\"\/><\/figure><\/div>\n\n\n\n<p>O GT decidiu retomar parcialmente a proposta que autoriza estados a cobrarem o Imposto sobre Transmiss\u00e3o Causa Mortis e Doa\u00e7\u00e3o (ITCMD) sobre aplica\u00e7\u00f5es em planos de previd\u00eancia privada transmitidos por meio de heran\u00e7a. A iniciativa chegou a constar em uma vers\u00e3o preliminar do PLP, mas foi retirada pelo governo ap\u00f3s repercuss\u00e3o negativa. A inten\u00e7\u00e3o era uniformizar o tributo, pois alguns estados j\u00e1 cobram o imposto, mas n\u00e3o h\u00e1 uma regra geral sobre o tema.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><a href=\"http:\/\/www.ferrarimaquinas.com.br\/\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/jornalfatosenoticias.com.br\/wp-content\/uploads\/2022\/02\/FERRARI_MAQUINAS-E-FERRAMENTAS2.jpg\" alt=\"\" class=\"wp-image-27860\" width=\"300\" height=\"250\"\/><\/a><\/figure><\/div>\n\n\n\n<p>Hoje, por serem considerados uma esp\u00e9cie de seguro, planos do tipo VGBL (Plano Vida Gerador de Benef\u00edcio Livre) em geral n\u00e3o s\u00e3o taxados quando transferidos. Para a modalidade PGBL (Plano Gerador de Benef\u00edcio Livre) h\u00e1 regras diferentes dependendo do estado, o Supremo Tribunal Federal (STF) analisa uma defini\u00e7\u00e3o sobre a incid\u00eancia do tributo nesse tipo de aplica\u00e7\u00e3o.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><a href=\"https:\/\/panper.com.br\/\"><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/jornalfatosenoticias.com.br\/wp-content\/uploads\/2023\/03\/logo-Panper_portal.jpg\" alt=\"\" class=\"wp-image-40208\" width=\"347\" height=\"240\" srcset=\"https:\/\/jornalfatosenoticias.com.br\/wp-content\/uploads\/2023\/03\/logo-Panper_portal.jpg 400w, https:\/\/jornalfatosenoticias.com.br\/wp-content\/uploads\/2023\/03\/logo-Panper_portal-300x208.jpg 300w\" sizes=\"auto, (max-width: 347px) 100vw, 347px\" \/><\/a><\/figure><\/div>\n\n\n\n<p>O relat\u00f3rio estabelece que o ITCMD deve incidir sobre \u201caportes financeiros capitalizados sob a forma de planos de previd\u00eancia privada ou qualquer outra forma ou denomina\u00e7\u00e3o de aplica\u00e7\u00e3o financeira ou investimento, seja qual for a modalidade de garantia\u201d. A al\u00edquota ser\u00e1 definida pelo Senado. Al\u00e9m disso, a cobran\u00e7a depender\u00e1 de lei espec\u00edfica estadual ou do Distrito Federal para entrar em vigor. A atua\u00e7\u00e3o do colegiado n\u00e3o ser\u00e1 vinculada a qualquer \u00f3rg\u00e3o da administra\u00e7\u00e3o p\u00fablica.
