O Minist\u00e9rio P\u00fablico de S\u00e3o Paulo (MP-SP) autorizou o pagamento de penduricalhos aos promotores paulistas que chega a aproximadamente R$ 1 milh\u00e3o, valor retroativo ao per\u00edodo de 103 meses, contados no per\u00edodo entre janeiro de 2015 e agosto de 2023.\u00a0Segundo o jornal Folha de S. Paulo,<\/em> a justificativa para o pagamento \u00e9 a \u201ccompensa\u00e7\u00e3o por assun\u00e7\u00e3o de acervo”, ou seja, os servidores cumpriram cargas extras de trabalho para atendimentos dos processos da institui\u00e7\u00e3o.
De acordo com a reportagem, o impacto no cofre do Minist\u00e9rio P\u00fablico paulista deve ultrapassar R$ 1 bilh\u00e3o, com pagamentos entre R$ 400 mil e R$ 1 milh\u00e3o por promotor.\u00a0O penduricalho deve ser pago a cerca de 1,9 mil promotores e procuradores referentes a 10 dias de trabalho extra em cada m\u00eas do per\u00edodo mencionado. O \u00f3rg\u00e3o paulista tem 2,9 mil membros, entre ativos e inativos, segundo o Portal da Transpar\u00eancia.<\/p>\n\n\n\n

A Folha<\/em> revelou que o documento que circulou internamento na \u00faltima segunda-feira (3) foi distribu\u00eddo pelo procurador-geral de Justi\u00e7a, Paulo S\u00e9rgio de Oliveira e Costa, com os c\u00e1lculos previstos para incorpora\u00e7\u00e3o dos valores na folha salarial dos promotores. O penduricalho ainda deve ser pago pelo per\u00edodo de carga extra de trabalhos nos processos entre setembro de 2023 a novembro de 2024. Os valores ainda n\u00e3o foram calculados.<\/p>\n\n\n\n

Em nota, o MP-SP declarou que “n\u00e3o h\u00e1 previs\u00e3o de desembolso no momento. O repasse ser\u00e1 feito oportunamente, de forma paulatina, de acordo com a disponibilidade or\u00e7ament\u00e1ria”. O \u00f3rg\u00e3o acrescenta ainda “que o direito ora reconhecido a cerca de 1.900 membros do Minist\u00e9rio P\u00fablico, assim como j\u00e1 ocorreu com outras carreiras jur\u00eddicas, fundamenta-se na legisla\u00e7\u00e3o vigente e foi chancelado pelos \u00f3rg\u00e3os de controle, como o Conselho Nacional do Minist\u00e9rio P\u00fablico (CNMP) e o Conselho Nacional de Justi\u00e7a (CNJ), seguindo rigorosamente o comando constitucional da simetria com outras carreiras”.<\/p>\n\n\n\n

A nota do MP-SP se refere \u00e0 recomenda\u00e7\u00e3o do CNMP, feita aos \u00f3rg\u00e3o estaduais em 2022, para regulamenta\u00e7\u00e3o do direito \u00e0 \u201ccompensa\u00e7\u00e3o por assun\u00e7\u00e3o de acervo”. O Supremo Tribunal Federal (STF) entende que esses benef\u00edcios t\u00eam car\u00e1ter indenizat\u00f3rio, n\u00e3o s\u00e3o considerados como sal\u00e1rio e assim, ficam de fora do c\u00e1lculo do teto salarial do funcionalismo.<\/p>\n\n\n\n

No ano passado, a m\u00e9dia de rendimento l\u00edquido dos promotores e procuradores foi de R$ 58,5 mil mensais. O teto salarial dos promotores de carreira \u00e9 de R$ 37,7 mil e dos procuradores \u00e9 de R$ 39,7 mil.<\/p>\n\n\n\n
