As medidas regulamentam decis\u00f5es recentes do Supremo Tribunal Federal (STF) e colocam a Autoridade Nacional de Prote\u00e7\u00e3o de Dados (ANPD) como respons\u00e1vel por monitorar se plataformas digitais est\u00e3o cumprindo as novas obriga\u00e7\u00f5es impostas pela Corte.<br>Os decretos foram assinados sem necessidade de aprova\u00e7\u00e3o do Congresso Nacional e ainda ser\u00e3o publicadas no Di\u00e1rio Oficial da Uni\u00e3o (DOU). Um dos textos atualiza normas do Marco Civil da Internet, criado em 2014, enquanto o outro estabelece a\u00e7\u00f5es voltadas ao combate da misoginia e da viol\u00eancia contra a mulher no ambiente digital.<br>Com a nova regulamenta\u00e7\u00e3o, a ANPD, \u00f3rg\u00e3o ligado ao Minist\u00e9rio da Justi\u00e7a, deixa de atuar apenas na prote\u00e7\u00e3o de dados pessoais e passa a assumir uma fun\u00e7\u00e3o mais ampla na supervis\u00e3o das redes sociais. A ag\u00eancia tamb\u00e9m j\u00e1 acumula a responsabilidade de monitorar o chamado ECA Digital, legisla\u00e7\u00e3o que entrou em vigor em mar\u00e7o deste ano com regras voltadas \u00e0 prote\u00e7\u00e3o de crian\u00e7as e adolescentes nas plataformas.<br>Desde o in\u00edcio deste terceiro mandato, Lula tem travado um forte embate com as big techs, defendendo a regula\u00e7\u00e3o para evitar o que considera como crimes de \u00f3dio e, em sua vis\u00e3o, a profus\u00e3o de fake news. A principal mudan\u00e7a ocorre na responsabiliza\u00e7\u00e3o das plataformas por conte\u00fados publicados por terceiros, em o STF passou a permitir puni\u00e7\u00f5es mesmo sem decis\u00e3o judicial em determinadas situa\u00e7\u00f5es. Nessas situa\u00e7\u00f5es, as pr\u00f3prias plataformas dever\u00e3o agir rapidamente para retirar conte\u00fados do ar, sob risco de serem responsabilizadas por \u201cfalhas sist\u00eamicas\u201d em seus sistemas de controle.<br>O novo decreto tamb\u00e9m estabelece que redes sociais dever\u00e3o remover conte\u00fados ilegais ap\u00f3s simples notifica\u00e7\u00e3o, mesmo sem ordem judicial. As empresas ter\u00e3o de criar canais de den\u00fancia, informar os usu\u00e1rios sobre medidas adotadas e permitir contesta\u00e7\u00e3o das decis\u00f5es, em um modelo que o governo compara a um \u201cdevido processo legal\u201d.<br>As plataformas ainda ser\u00e3o obrigadas a combater an\u00fancios considerados fraudulentos, como golpes financeiros, promo\u00e7\u00f5es enganosas e venda de produtos ilegais. Outra exig\u00eancia prev\u00ea que as empresas armazenem dados das publica\u00e7\u00f5es para auxiliar futuras investiga\u00e7\u00f5es criminais e a\u00e7\u00f5es judiciais movidas por consumidores prejudicados. O texto, por\u00e9m, traz salvaguardas para determinados tipos de manifesta\u00e7\u00f5es, com a prote\u00e7\u00e3o a conte\u00fados classificados como \u201ccr\u00edtica, par\u00f3dia, s\u00e1tira, conte\u00fado informativo (not\u00edcia), manifesta\u00e7\u00e3o religiosa e liberdade de cren\u00e7a\u201d.<br>A Ag\u00eancia Nacional de Prote\u00e7\u00e3o de Dados, criada inicialmente para fiscalizar a legisla\u00e7\u00e3o de prote\u00e7\u00e3o de dados pessoais, passa agora a ter atua\u00e7\u00e3o ampliada sobre o ambiente digital. Al\u00e9m de monitorar regras do chamado ECA Digital, a ANPD tamb\u00e9m ficar\u00e1 encarregada de supervisionar se as plataformas est\u00e3o adotando medidas preventivas para combater crimes e golpes na internet.<br>As big techs dever\u00e3o enviar relat\u00f3rios peri\u00f3dicos \u00e0 ANPD detalhando as a\u00e7\u00f5es implementadas para cumprir as novas normas. As plataformas ser\u00e3o obrigadas a disponibilizar canais espec\u00edficos para den\u00fancias envolvendo nudez real ou imagens falsas produzidas por intelig\u00eancia artificial.<br>Nesses casos, o conte\u00fado dever\u00e1 ser removido em at\u00e9 duas horas ap\u00f3s a den\u00fancia feita pela v\u00edtima ou por representante legal. As empresas tamb\u00e9m ter\u00e3o de reduzir, por meio dos algoritmos, o alcance de ataques coordenados contra mulheres, incluindo campanhas de persegui\u00e7\u00e3o contra jornalistas e figuras p\u00fablicas.<br>Outra medida pro\u00edbe que plataformas disponibilizem ferramentas de intelig\u00eancia artificial capazes de criar \u201cnudes\u201d falsos a partir de imagens reais.
